Terms of Service

By accessing or using Mobily ("Service"), operated by TechSynergy Corp. ("Company", "we", "us", "our"), a corporation registered in the Province of Ontario, Canada, you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of these Terms, you may not access the Service.
These Terms apply to all visitors, users, and others who access or use the Service. These Terms constitute a legally binding agreement between you and TechSynergy Corp.
Mobily is a link shortening and management service that allows users to:
- Create shortened URLs for long web addresses
- Track analytics and click data for shortened links
- Customize short links with custom codes
- Manage and organize link campaigns
- Access the API for programmatic link creation
3.1 Account Creation
To use the Service (Mobily™), you must create an account by providing your full legal name, a valid email address, and a password. You represent and warrant that:
- The full name you provide at registration is your real legal name as it appears on your government-issued identification
- You are at least 18 years of age or the age of majority in your province or territory
- You are a resident of Canada or the United States
- All information you provide is accurate, current, and complete
- You will maintain the confidentiality of your account credentials
- You accept responsibility for all activities that occur under your account
- You will notify us immediately of any unauthorized use
3.2 Identity Verification
We reserve the right to request additional identity verification at any time, including but not limited to government-issued photo identification, proof of address, or other documentation. Failure to provide requested verification within 7 business days may result in account suspension. Providing false identity information constitutes fraud and grounds for immediate account termination without refund.
3.3 Account Termination
We reserve the right to suspend or terminate your account immediately and without prior notice if you: (a) violate these Terms; (b) provide false or misleading identity or payment information; (c) engage in fraudulent, abusive, or illegal activity; (d) initiate an unauthorized chargeback or payment dispute; or (e) use the Service from outside Canada using VPN or proxy services to circumvent geographic restrictions.
You agree not to use the Service to:
- Shorten links to illegal, harmful, or malicious content
- Distribute malware, viruses, or other harmful code
- Engage in phishing, scamming, or fraudulent activities
- Harass, threaten, or harm others
- Violate intellectual property rights
- Distribute spam or unsolicited communications
- Link to content that promotes violence, hate speech, or discrimination
- Bypass our security measures or abuse the Service
- Use the Service for any illegal purpose
We reserve the right to remove or disable any links that violate this policy without prior notice.
5.1 Plans and Pricing
TechSynergy Corp. offers a free plan through its Mobily™ service and paid subscription plans. All prices are listed in Canadian Dollars (CAD). Pricing and features are detailed on our pricing page and may be changed with 30 days' notice to existing subscribers.
5.2 Billing
- Paid subscriptions are billed monthly or annually in advance in Canadian Dollars (CAD)
- All payments are processed securely through Stripe, a PCI-DSS Level 1 certified payment processor
- Subscriptions automatically renew unless cancelled before the renewal date
- You authorize us to charge your payment method on each billing cycle
- Failed payments will be retried up to 3 times over a 7-day period before service suspension
5.3 Payment Requirements and Restrictions
To prevent fraud and protect both our customers and our business, the following payment requirements apply:
- Canadian or US credit or debit cards only. We only accept payment methods issued by Canadian or US financial institutions. Cards from other countries will be declined.
- Cardholder name must match registration name. The name on the credit or debit card used for payment must exactly match the full legal name provided during account registration. Payments where the cardholder name does not match the account holder's name will be flagged, and the subscription will not be activated until verified.
- No third-party payments. You may not use a credit card, debit card, or payment method belonging to another person. Each user must pay with their own payment method in their own name.
- 3D Secure authentication is required for all transactions where supported by your card issuer, providing an additional layer of verification.
- Billing address verification. A valid Canadian or US billing address is required and will be verified against your card's registered address.
5.4 Refund Policy
We offer a 14-day money-back guarantee on your initial subscription purchase. To request a refund, contact us within 14 calendar days of your first payment. After the 14-day period, no refunds will be issued for any reason, including but not limited to:
- Subscription renewals (monthly or annual)
- Mid-cycle cancellations
- Downgrades to a lower plan
- Unused service during the billing period
- Accounts suspended or terminated for Terms violations
Refunds are processed to the original payment method only. Processing may take 5-10 business days to appear on your statement.
5.5 Cancellation
You may cancel your subscription at any time from your account settings or by contacting us. Upon cancellation:
- Your subscription will remain active until the end of your current billing period
- No partial or prorated refunds will be issued for the remaining time
- Your account will be downgraded to the free plan at the end of the billing period
- Your existing short links will continue to redirect, subject to free plan limits
6.1 Fraud Prevention Measures
We employ multiple fraud prevention measures to protect our business and our customers, including but not limited to: identity verification, geographic restrictions, card country verification, cardholder name matching, billing address verification, 3D Secure authentication, risk scoring, and IP-based fraud detection. By using the Service, you consent to these verification measures.
6.2 Account Flagging
If our systems detect suspicious activity, including but not limited to name mismatches, non-Canadian payment methods, unusual IP patterns, or elevated risk scores, your account may be automatically flagged for manual review. Flagged accounts will have their subscription suspended pending verification. You may be required to provide additional identification to reactivate your account.
6.3 Chargebacks and Payment Disputes
You agree to contact us directly before initiating any chargeback or payment dispute with your bank or credit card company. We are committed to resolving billing issues promptly and fairly.
If you initiate a chargeback or payment dispute without first attempting to resolve the issue directly with us:
- Your account will be immediately suspended pending investigation
- We reserve the right to permanently terminate your account
- We will provide all relevant evidence to the payment processor to contest fraudulent or unwarranted chargebacks, including proof of service delivery, account activity logs, registration details, and IP addresses
- You may be liable for a chargeback administration fee of $25.00 CAD per dispute to cover processing costs incurred by us
- If the chargeback is found to be fraudulent or unwarranted, we reserve the right to pursue collection of the disputed amount plus all associated fees and costs
Fraudulent chargebacks (chargebacks filed despite having received and used the Service) constitute a breach of these Terms and may be reported to credit reporting agencies and law enforcement authorities where permitted by law.
6.4 Service Availability
The Service is available to individuals and businesses located in Canada and the United States. We only accept payment methods issued by Canadian or US financial institutions and require a Canadian or US billing address. By subscribing to a paid plan, you represent and warrant that you are located in Canada or the United States and that your payment method is issued by a financial institution in your country of residence. Attempting to circumvent these geographic restrictions is a violation of these Terms.
Each subscription plan has specific limits on:
- Number of short links you can create
- Number of clicks per month
- Analytics data retention period
If you exceed your plan limits, you must upgrade to continue using the Service without interruption.
8.1 Our Rights
The Service, including all content, features, and functionality, is owned by TechSynergy Corp. (operating as Mobily) and is protected by copyright, trademark, and other intellectual property laws.
8.2 Your Content
You retain all rights to the URLs and content you shorten. By using our Service, you grant us a limited license to store and display your links for the purpose of providing the Service.
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:
- Merchantability or fitness for a particular purpose
- Uninterrupted or error-free operation
- Accuracy or reliability of data
- Security of your data or links
TO THE MAXIMUM EXTENT PERMITTED BY LAW, MOBILY SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES RESULTING FROM:
- Your use or inability to use the Service
- Unauthorized access to or alteration of your data
- Any third-party content or conduct on the Service
- Service interruptions or termination
Our total liability shall not exceed the amount you paid us in the 12 months preceding the claim.
You agree to indemnify and hold harmless TechSynergy Corp., its officers, directors, employees, and agents (collectively, "Mobily") from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:
- Your violation of these Terms
- Your use of the Service
- Content you shorten or link to
- Your violation of any third-party rights
Your use of the Service is also governed by our Privacy Policy, which is incorporated into these Terms by reference. Please review the Privacy Policy to understand how we collect, use, and protect your personal information.
All data is stored on servers located in Canada and is subject to the Personal Information Protection and Electronic Documents Act (PIPEDA) and other applicable Canadian privacy laws.
We reserve the right to modify, suspend, or discontinue the Service (or any part thereof) at any time with or without notice. We will not be liable to you or any third party for any modification, suspension, or discontinuance.
We may update these Terms from time to time. We will notify you of material changes by posting a notice on our website or sending you an email. Your continued use of the Service after such changes constitutes acceptance of the new Terms.
These Terms shall be governed by and construed in accordance with the federal laws of Canada and the laws of the Province of Ontario, without regard to conflict of law provisions. You agree that the courts of the Province of Ontario, located in the Regional Municipality of York, shall have exclusive jurisdiction over any disputes arising from these Terms or your use of the Service, regardless of your country of residence. US-based users acknowledge and agree to this Canadian jurisdiction.
Before initiating any formal dispute resolution, you agree to first contact us and attempt to resolve the dispute informally for a minimum of 30 calendar days.
If the dispute cannot be resolved informally, it shall be resolved through binding arbitration administered in accordance with the Arbitration Act, 1991 (Ontario), to be conducted in the English language in the Regional Municipality of York, Ontario. The arbitrator's decision shall be final and binding. Judgment on the award may be entered in any court of competent jurisdiction.
Class Action Waiver: You agree that any dispute resolution proceedings will be conducted on an individual basis and not as a class action, consolidated action, or representative action. You waive any right to participate in a class action lawsuit or class-wide arbitration against TechSynergy Corp.
TechSynergy Corp. shall not be liable for any failure or delay in performing its obligations under these Terms where such failure or delay results from circumstances beyond our reasonable control, including but not limited to: natural disasters, acts of government, power outages, internet or telecommunications failures, cyberattacks, pandemics, labour disputes, or disruptions to third-party services on which the Service depends. During any such event, our obligations under these Terms shall be suspended for the duration of the force majeure event.
If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions will remain in full force and effect.
These Terms, together with our Privacy Policy and Cookie Policy, constitute the entire agreement between you and TechSynergy Corp. regarding your use of the Service. These Terms supersede any prior agreements, communications, or understandings, whether written or oral, relating to the subject matter herein. No waiver of any provision of these Terms shall be deemed a further or continuing waiver of such provision or any other provision.
